Book Description :

The goal of this book is to provide comprehensive and practical knowledge of relevant legal issues that affect the administration of public schools. It will allow educators to effectively perform their duties within the boundaries of constitutional, statutory, and case law. It is also designed to be easy to understand for those with little or no legal background. Selected court cases address issues most relevant to education. It includes recent landmark court decisions in areas such as religion, student rights, student and faculty disabilities, and classroom harassment. School violence is discussed comprehensively. The book begins with an index of major legal issues related to relevant issues, allowing the reader to ascertain the legal sources of authority related to those particular topics. Educational leaders are provided with pertinent information to direct their day-to-day decisions. The primary focus is not on state law since this varies from state to state. Appendices include constitutional provisions, selected and annotated federal statutes, and an abbreviated glossary. It will enable educators to perform their legal duties and to meet the requirements of reasonableness as they move their organizations toward their goals. (Contains 279 references.) (RKJ)

Book Description :

Controversial Supreme Court decisions have barred organized school prayer, but neither the Court nor public policy exclude religion from schools altogether. In this book, one of America's leading constitutional scholars asks what role religion ought to play in public schools. Kent Greenawalt explores many of the most divisive issues in educational debate, including teaching about the origins of life, sex education, and when--or whether--students can opt out of school activities for religious reasons. Using these and other case studies, Greenawalt considers how to balance the country's constitutional commitment to personal freedoms and to the separation of church and state with the vital role that religion has always played in American society. Do we risk distorting students' understanding of America's past and present by ignoring religion in public-school curricula? When does teaching about religion cross the line into the promotion of religion? Tracing the historical development of religion within public schools and considering every major Supreme Court case, Greenawalt concludes that the bans on school prayer and the teaching of creationism are justified, and that the court should more closely examine such activities as the singing of religious songs and student papers on religious topics. He also argues that students ought to be taught more about religion--both its contributions and shortcomings--especially in courses in history. To do otherwise, he writes, is to present a seriously distorted picture of society and indirectly to be other than neutral in presenting secularism and religion. Written with exemplary clarity and even-handedness, this is a major book about some of the most pressing and contentious issues in educational policy and constitutional law today.

Book Description :

This Brief reviews the past, present, and future use of school corporal punishment in the United States, a practice that remains legal in 19 states as it is constitutionally permitted according to the U.S. Supreme Court. As a result of school corporal punishment, nearly 200,000 children are paddled in schools each year. Most Americans are unaware of this fact or the physical injuries sustained by countless school children who are hit with objects by school personnel in the name of discipline. Therefore, Corporal Punishment in U.S. Public Schools begins by summarizing the legal basis for school corporal punishment and trends in Americans’ attitudes about it. It then presents trends in the use of school corporal punishment in the United States over time to establish its past and current prevalence. It then discusses what is known about the effects of school corporal punishment on children, though with so little research on this topic, much of the relevant literature is focused on parents’ use of corporal punishment with their children. It also provides results from a policy analysis that examines the effect of state-level school corporal punishment bans on trends in juvenile crime. It concludes by discussing potential legal, policy, and advocacy avenues for abolition of school corporal punishment at the state and federal levels as well as summarizing how school corporal punishment is being used and what its potential implications are for thousands of individual students and for the society at large. As school corporal punishment becomes more and more regulated at the state level, Corporal Punishment in U.S. Public Schools serves an essential guide for policymakers and advocates across the country as well as for researchers, scientist-practitioners, and graduate students.

Book Description :

This text is written for K-12 educators and others who have little background in school law and need to know the sources of law under which educators operate. It focuses on an understanding of legal rationale and the principles that inform practice. Relevant case law, statutory law, constitutional provisions, and commentary are provided to develop a basic understanding of school law issues and the legal rationale underpinning such law. Broad legal concepts such as due process, equal protection, freedom of expression, the wall separating church and state, and reasonable search are stressed to help professional educators gain a better understanding of the legal landscape in which they operate. The case method of studying school law is emphasized. Selected cases present legal concepts in a real world context, assisting students in making the essential connection between more abstract general principles of law and their operational application in schools. This text is revised every three years to present the most current available information. But because the law changes rapidly, this text also provides students with essential skills and tools necessary for basic legal research, case citation, analyzing judicial decisions, and understanding the operations of state and federal systems of government. Lastly, but most importantly, the text is written in a clear, understandable, and interesting manner, to actively engage students in lively discussion, and debate concerning the application of the law in schools. The auther provides notes and questions throughout the book to facilitate better understanding of the law and enable instructors to enrich learning through stimulating class discussions."

Book Description :

This text provides a clear and concise view of current perspectives in school law and makes the all-important leap from theory to practice, with a focus on the day-to-day realities of school law. Subjects include student rights, teacher rights, tort action, power and authority, change, and conflict. While the topics of corporal punishment, free speech, and church and state have been debated by lawyers for years, the law is ever changing to encompass new subjects involving handicapped students, AIDS, and more. Teachers, to be sure, are not expected to be lawyers or to possess a mastery of the law. They are, however, able to obtain a fundamental knowledge of it, especially with the assistance of Law in Arkansas Public Schools . This fundamental knowledge provides teachers with information that today rivals reading, writing, and arithmetic in importance. In this day and age, when students and parents sue schools and teachers, the best defense for teachers and administrators is simply to know the law. Professor Paul E. Peterson teaches administration and secondary education at the University of Central Arkansas. A former public school teacher and principal, he received his Ed.D. in 1983 from the University of Akron. Dr. Peterson teaches school law at UCA and has presented numerous workshops on this topic for teachers, administrators, and school boards throughout the state.

Book Description :

The American Dream and the Public Schools examines issues that have excited and divided Americans for years, including desegregation, school funding, testing, vouchers, bilingual education, and ability grouping. While these are all separate problems, much of the contention over them comes down to the same thing--an apparent conflict between policies designed to promote each student's ability to succeed and those designed to insure the good of all students or the nation as a whole. The authors show how policies to promote individual success too often benefit only those already privileged by race or class, and often conflict with policies that are intended to benefit everyone. They propose a framework that builds on our nation's rapidly changing population in order to help Americans get past acrimonious debates about schooling. Their goal is to make public education work better so that all children can succeed.
