Book Description :

The Church's involvement in preparation for marriage of its members has developed and adapted in order to respond to the particular needs of the church community, especially of the couples preparing for marriage at different times in history. In this regard, canon 1063 of the new code is particularly significant for our own time. This study, which is in three parts, sets out to examine canon 1063, which deals with the pastoral care of marriage preparation.

Book Description :

Marriage was ordained by God for the good of spouses and for procreation. But how often does marriage turn out to bring unhappiness to partners! And how often do even happy marriages end up childless! Among the Igbo of South-eastern Nigeria, to whom offspring is the chief goal of marriage, childlessness leads often to unhappiness in marriage and not less often to the break-up of marriages or to polygamy. In this work, the author expounds the importance of marriage and its practice among the Igbo. He explains the importance of children in Igbo understanding of marriage and identifies childlessness as the key factor which could endanger (and sometimes do endanger) the Igbo acceptance of the Catholic doctrine of the indissolubility of marriage. Using the relevant clauses of the Code of Canon Law, the author explains in detail the Catholic understanding of marriage and the goals of the catholic doctrine on marriage. He writes of the possibility of marriage impediments due to impotence and sterility (that lead to childlessness) and recommends not only a thorough pre-marriage preparation but also a continual formation of marriage couples as efforts that could check the increasing rate of divorce and polygamy due to childlessness. But the author knows that childlessness can still occur despite all precautions. He therefore recommends adoption (instead of polygamy) as the ultimate panacea to childlessness in marriage. The author condemns in unmistakable terms the mentality among the Igbo which blames and traumatizes the woman in cases of childlessness.

Book Description :

Many marriages are “ended” by separation or divorce, but for the baptized Christian they remain valid marriages forever. There are, however, cases in which a Christian marriage can be recognized as null, i.e. it never existed. This book, written by a specialist with a gift for clarity on a complicated, sensitive issue, is a guide for a first approach to the problems related to the conditions for eventually declaring the nullity of a canonical Christian marriage. This work is an indispensable aid for the pastors of souls, for Catholic counselors, and can be very useful also for anyone who has serious questions about the validity of his own marriage. The primary purpose of this work is to provide clear, well-founded information in sufficient quantity to parish priests and to all who will act as counselors in these matters, either in formally organized parochial counseling services, or in other possible forms of collaboration with the parish priest, or else in the ecclesiastical tribunals themselves as a step previous to the possible introduction of the case. Among the areas he covers are: Violation of the freedom of consent; Error about a person; Exclusion of offspring; Exclusion of fidelity; Incapacity to consent; Incapacity to assume the essential obligations of marriage; Conditional consent.

Book Description :

The National Statistics office of both the government of Netherlands Antilles and Aruba has indicated 41% of the total number of marriage both civil and ecclesiastical ended up in divorce. This is an alarming percentage of divorce in the last ten years. Precisely, it is in this context that the diocese has been concerned by this pastoral problem that is why the diocese of Willemstad has come up with the "Direktorio pa Celebracion di Sacramentunan." This "Direktorio" is an attempt to provide more effective pre-marrige preparation and serve as guidelines for the celebration of the sacraments. The purpose of this research is to examine this "Direktorio" in the light of the provisions of the 1983 Code of Canon Law, to elaborate the existing pre-marrige program of the diocese. This reasearch also examine the present Church's understanding of the pastoral care for the celebration of marriage, the views of the late Pope John II in the instruction Familiaris Consortio and the Pontifical Council for the Family's document Preparation for the Sacarament of Marriage. The signiicance of this study is providing significant information both for the couple who is preparing to receive the sacrament of marriage and for the pastoral team including the parish priest to be properly equipped with knowledge of the value, understanding, importance of marriage and the proper guidance to become an effective agent in preparing a couple for the sacrament of marriage. Chapter II of this paper work is all about the pastoral care and the canonical norms on preparations for marriage. It discusses the exhortation Familiaris Consortio of Pope John Paul II. Chapter III elaborates the pre-marrige program of the diocese of Willemstad. The first part of this chapter speaks about the diocesan profile. The second part explains the Diocesan norms for marriage preparation based in the "Direktorio" the revised edition of the old Vademecum to address the uniformity and the appropriate celebration of and preparation for the sacraments. The last section provides the immediate and the pastoral preparation of those engaged entering marriage. The third part of this chapter is all about the pre-marriage seminar given by the team composed of priest, a medical practitioner, host couple and other staff couple. Chapter IV is about the critique of the pre-marriage program of the diocese of Willemstad. The first part is the critique of the diocesan norms for marriage preparation. The second part is the critique of the marriage preparation based on the Familiaris Consortio and the last part is the proper critique of the provision of Canon 1063 as it applies to our diocese. Chapter V is the practical recommendations on how to improve the pre-marriage program of the diocese.

Book Description :

When Monsignor Thomas J. Green, professor at the School of Canon Law at The Catholic University of America, approached his seventy-fifth birthday and the fiftieth anniversary of his priestly ordination, his colleagues planned on offering him a fitting tribute in the form of a festschrift. Six people with different backgrounds, but all related to Msgr. Green on one way or another, have written a laudatio – a short congratulatory letter – in honor of Monsignor Green. No less than fifteen contributions on various topics by colleagues, canon law scholars, clearly relate and reflect upon the honoree's scholarly contributions to canon law. The topics are extremely varied, and illustrate how Monsignor Green has been or is active in nearly every area of canon law. Virtually every book of the Code of Canon Law is covered, if not directly, at least indirectly. While the book is a tribute to an eminent professor, the various scholarly contributions are unique pieces of scholarship. The authors of the laudatio are: John Garvey (President, The Catholic University of America); Andrew Abela (Provost, The Catholic University of America); Rev. Msgr. J. Brian Bransfield (General Secretary of the United States Conference of Catholic Bishops); Rev. Msgr. Ronny E. Jenkins (Dean, School of Canon Law, The Catholic University of America); Rev. Msgr. J. James Cuneo (Diocese of Bridgeport) and Sister Sharon Euart, RSM (Executive Director, Resource Center for Religious Institutes, Silver Spring, MD).
